Terms & Conditions

These Terms govern all quotations, orders, and shipments between Damlataş Marble ("we," "Seller") and any buyer, distributor, architect, or contractor ("you," "Buyer"). By requesting a quotation or placing an order, you accept these Terms in full.

1. Quotations and Pricing

Quotations are valid for 15 days from issuance, in USD or EUR as specified. Prices reflect current ocean freight rates, quarry availability, and exchange rates at the time of quotation, and may be adjusted for material changes, freight volatility above 10%, or significant currency fluctuation. Volume discounts and long-term partnership pricing are available on request.

2. Orders and Cancellation

An order is confirmed only after written acceptance by both parties and receipt of advance payment.

Once production begins, orders cannot be cancelled. Cancellation before production: 100% refund within 7 days of confirmation; 70% refund thereafter; no refund after production starts.

Minimum order: 1 full container (FCL). Smaller orders (LCL) available with additional handling fees.

3. Payment

Standard terms: 30% advance on order confirmation, 70% against copy of Bill of Lading before document release.

We accept T/T, Letter of Credit (L/C at sight for orders above USD 50,000), and Documentary Collection. All payments in the currency stated on the Proforma Invoice. Late payments accrue 1.5% interest per month and may result in suspension of production or shipment.

Title to goods transfers to the Buyer only upon full payment.

4. Production, Photo Approval, and Factory Visits

Lead times range from 7–14 days for stock items to 20–35 days for cut-to-size and custom orders, confirmed in writing on the Proforma Invoice.

Before any container is loaded, we send the Buyer detailed photographs of the finished material — slabs, tiles, color batches, and packaging — for written approval. Nothing ships without the Buyer's confirmation.

Buyers are welcome to visit our factory in Denizli at any stage to inspect material in person and conduct independent quality control.

5. Shipping and Incoterms

All shipments follow Incoterms 2020 as specified on the Proforma Invoice (typically FOB Izmir, CIF, or DAP).

Transit times are estimates, not guarantees. Risk of loss transfers according to the agreed Incoterm. Marine insurance is included on CIF shipments; under FOB, insurance is the Buyer's responsibility.

Demurrage, detention, or storage charges at the destination port arising from delays on the Buyer's side are the Buyer's responsibility.

6. Quality and Natural Stone Variation

Marble and travertine are natural materials. Variations in color, veining, pattern, and porosity are inherent characteristics, not defects. Samples serve as a general reference; reasonable variation between samples and shipment is normal and accepted.

All Products meet applicable Turkish and European standards. Technical data (ASTM, EN) is available on request. Goods are packed in ISPM-15 certified crates with protective interlayers.

7. Inspection and Claims

The Buyer must inspect Products on arrival. Claims must be:

• Visible damage or shortage: reported in writing within 7 days of arrival, with photographs and a survey report (SGS, Bureau Veritas, or equivalent) where applicable.

• Hidden defects: reported within 30 days of arrival with supporting evidence.

Valid claims are resolved through replacement in next shipment, credit note, or partial refund. No claims will be accepted after the material has been installed.

We are not liable for installation costs, project delays, consequential damages, or third-party claims. Our total liability under any order is limited to the invoiced value of the affected Products.

8. Warranties

We warrant that all Products are sourced from our owned quarries in Denizli, conform to agreed specifications and approved samples, and are free from manufacturing defects at the time of shipment.

We provide no warranty for damage from improper handling, transportation, installation, or exposure to acidic substances or harsh chemicals, nor for natural variations within reasonable range.

9. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, armed conflict, terrorism, government actions, embargoes, pandemics, strikes, port closures, ocean freight disruptions, regional shipping route closures, severe weather, or infrastructure failure. Delivery times extend for the duration of such events.

10. Confidentiality and Data Protection

All commercial information exchanged between the parties is confidential and may not be disclosed without written consent, except where required by law.

Personal data is processed in accordance with our Privacy Policy, in compliance with GDPR and KVKK.

11. Intellectual Property

All trademarks, logos, photographs, and technical documentation are the exclusive property of Damlataş Marble and may not be reproduced or distributed without written consent.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Turkey, with reference to Incoterms 2020.

Disputes will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be settled by arbitration under the rules of the Istanbul Chamber of Commerce (ITOTAM), seated in Istanbul, in English. Where arbitration does not apply, the competent courts of Denizli, Turkey have exclusive jurisdiction, without prejudice to mandatory rights of consumers under their local law.

13. General

If any provision of these Terms is found invalid, the remaining provisions stay in effect. These Terms, the Proforma Invoice, and our Privacy Policy form the entire agreement between the parties. We may update these Terms at any time; the most current version is published on this page. For ongoing orders, the Terms in effect at order confirmation apply.
